I sistemi informatici e le procedure software preposte al funzionamento di questo sito web acquisiscono, nel corso del loro funzionamento, alcuni dati personali la cui trasmissione è implicita nell’uso dei protocolli di comunicazione di Internet.
Si tratta di informazioni che non sono raccolte per essere associate a interessati identificati, ma che per loro stessa natura potrebbero, attraverso elaborazioni ed associazioni con dati detenuti da terzi, permettere di identificare gli utenti.
In questa categoria di dati rientrano gli indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che si connettono al sito, gli indirizzi in notazione URI (Uniform Resource Identifier) delle risorse richieste, l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, il codice numerico indicante lo stato della risposta data dal server (buon fine, errore, ecc.) ed altri parametri relativi al sistema operativo e all’ambiente informatico dell’utente.
Questi dati vengono utilizzati al solo fine di ricavare informazioni statistiche anonime sull’uso del sito e per controllarne il corretto funzionamento e vengono cancellati immediatamente dopo l’elaborazione. I dati potrebbero essere utilizzati per l’accertamento di responsabilità in caso di ipotetici reati informatici ai danni del sito: salva questa eventualità, allo stato i dati sui contatti web non persistono per più di sette giorni

COMPILAZIONE FORM E PROGETTO A POSTCARD FOR FLOYD
GG, in qualità di Titolare del trattamento, ti informa che i tuoi dati personali e le informazioni di identificazione personale di seguito denominati “Dati Personali” o semplicemente “Dati”, che sono stati o saranno raccolti, anche verbalmente, da noi o da terzi, potranno essere trattati nel pieno rispetto del Regolamento UE. I Dati raccolti per il progetto sono nome, cognome, pseudonimo, indirizzo, numero di telefono, indirizzo e-mail, carta d’identità, data e luogo di invio della cartolina, eventuale testo, disegni e immagini forniti sulla o con la cartolina.
La compilazione dei form o l’invio di comunicazione tramite il sito web comporterà il trattamento dei dati di contatto necessari a rispondere.
- Base giuridica e scopo del trattamento
Per i dati di navigazione
La finalità del trattamento è consentire la navigazione del sito web ed è collegata alla tua volontà di visitare il sito ed utilizzare le sue funzionalità.
Per il form e per il progetto A postcard for Floyd
La base giuridica del trattamento è il libero consenso (art. 7 del GDPR), per le seguenti finalità:
– stampa della cartolina su libri, riviste, comunicati stampa, manifesti pubblicitari;
– pubblicazione della cartolina su siti web, social media, comunicati stampa, manifesti pubblicitari;
– esposizione della cartolina su mostre d’arte, fiere d’arte, eventi mediatici;
– eventi informativi e promozionali correlati alle pubblicazioni, alla mostra e a qualsiasi altro evento legato al progetto “A postcard for Floyd”;
– il nome dell’autore, la data e il luogo dell’invio saranno pubblicati insieme alla cartolina e ai suoi testi, disegni e immagini.
- Modalità di raccolta, di trattamento, tempi di conservazione dei dati e altre informazioni
I tuoi Dati Personali saranno raccolti sia tramite cartoline e modelli cartacei, sia tramite form sul sito web. I dati saranno trattati su supporto cartaceo e con mezzi elettronici e/o automatizzati, in modo da garantire la sicurezza e la riservatezza dei dati.
I dati di navigazione saranno raccolti durante la tua visita sul sito web.
Il Titolare tratterà i tuoi Dati Personali per il periodo di tempo necessario alle finalità di cui sopra fino alla revoca del consenso e comunque non oltre il periodo di tempo consentito dalla legge dopo la cessazione del tuo rapporto con il Titolare.
Il diritto di revocare il consenso non è retroattivo, il che significa che eventuali trattamenti avvenuti prima che tu revocassi il consenso non diventeranno illegali con la revoca.
Le cartoline non saranno messe in vendita e saranno conservate per l’archiviazione.
I tuoi dati non saranno utilizzati per la profilazione o per un processo decisionale automatizzato.
- Accesso ai dati e comunicazione dei dati
I suoi Dati possono essere consultati per le finalità menzionate ai punti precedenti:
– da fornitori di servizi di web host e per la manutenzione del sito web
– da editori, stampa, social media, inserzionisti, gallerie d’arte sia in Italia che all’estero.
Tali soggetti agiscono in qualità di Responsabili del trattamento.
L’elenco completo di tutti i soggetti che hanno o possono avere accesso ai tuoi Dati è disponibile presso la nostra sede.
Senza il tuo espresso consenso (art. 6, punti b) e c) del Regolamento UE), il Titolare potrà comunicare i tuoi Dati a Organismi di Vigilanza, Autorità Giudiziarie, società di assicurazione per la fornitura di servizi di assicurazione e altri soggetti ai quali la legge prescrive che i Dati debbano essere comunicati per le finalità sopra indicate.
Tali soggetti tratteranno i tuoi dati in qualità di responsabili del trattamento indipendenti dal Titolare.
I tuoi Dati non saranno oggetto di diffusione.
- Trasferimento dei Dati
I tuoi Dati Personali sono conservati in archivi fisici e server informatici che si trovano presso la sede del Titolare del trattamento o presso i fornitori, all’interno dell’Unione Europea.
Resta inteso che, se necessario, il Titolare del trattamento avrà la facoltà di trasferire i tuoi Dati in paesi extra UE. In tal caso, il Titolare del trattamento garantisce che l’eventuale trasferimento dei tuoi Dati al di fuori dell’Unione Europea avverrà nel rispetto delle leggi applicabili, previa redazione delle condizioni contrattuali standard o decisioni di adeguatezza della Commissione Europea.
Il Titolare ha applicato misure tecniche e organizzative adeguate per garantire un adeguato livello di sicurezza sia per i Dati conservati sui propri dispositivi, sia per i Dati conservati dai fornitori, nel pieno rispetto dell’articolo 32 del Regolamento UE.
- Come comunichi i tuoi dati e cosa succede se non comunichi i tuoi dati
Il conferimento dei dati non è obbligatorio. Per i dati di navigazione, il mancato conferimento potrebbe comportare la non accessibilità del sito web o di alcune sue funzioni. Per il progetto A postcard for Floyd, il mancato conferimento non consentirà la partecipazione al progetto. Sei comunque libero di non comunicare alcun Dato o di revocare il consenso al trattamento in un momento successivo.
- I tuoi diritti
In qualità di titolare dei tuoi dati, hai i seguenti diritti previsti dall’articolo 15 del Regolamento UE:
- Hai il diritto di chiedere al Titolare del trattamento se i tuoi Dati personali sono oggetto di trattamento e, in caso affermativo, hai il diritto di accedere ai tuoi Dati personali e alle seguenti informazioni:
- a) la finalità del trattamento
- b) il tipo di Dati Personali trattati
- c) i soggetti ai quali i Dati Personali sono stati o saranno comunicati, e in particolare se tali soggetti si trovano all’estero o fanno parte di un’organizzazione internazionale
- d) se possibile, il tempo designato per la conservazione dei Dati Personali o, se non possibile, i criteri con cui viene determinato il tempo di conservazione
- e) il diritto di richiedere al Titolare del trattamento la rettifica o la cancellazione dei Dati o la limitazione del trattamento, nonché il diritto di revocare il suo consenso al trattamento
- f) il diritto di proporre reclamo alle autorità di controllo (es. il “Garante”)
- g) se i Dati Personali non sono stati raccolti presso di te, hai il diritto di ricevere informazioni sull’origine dei Dati raccolti
- h) se viene effettuato un processo decisionale automatizzato, compresa la profilazione
- Se i tuoi Dati Personali sono trasferiti all’estero o ad un’organizzazione internazionale, hai il diritto di sapere se al trasferimento sono applicate garanzie adeguate ai sensi dell’articolo 46 del Regolamento UE.
- Su richiesta, il Titolare del trattamento ti invierà una copia dei tuoi Dati Personali oggetto di trattamento.
Se desideri ricevere ulteriori copie, il Titolare del trattamento può addebitarti ragionevoli costi di gestione. Se inoltri la tua richiesta per via elettronica, qualsiasi informazione ti sarà inviata in un formato elettronico comunemente utilizzato, a meno che tu non specifichi diversamente.
- Il diritto di ricevere una copia dei tuoi Dati Personali oggetto del trattamento di cui al precedente paragrafo 3 non può violare i diritti o la libertà di terzi.
Inoltre, ove applicabile, avete i seguenti diritti previsti dagli articoli da 16 a 22 del Regolamento UE:
– il diritto di modificare i suoi Dati Personali
– il diritto di far cancellare i suoi Dati Personali
– il diritto di limitare il trattamento dei suoi Dati Personali
– il diritto alla portabilità dei dati

Giangiacomo Rocco di Torrepadula (GG), acting as the “Data Controller”, hereby informs you according to Articles 13 and 14 of European Regulation no. 679/2016 (hereinafter “GDPR”) and D.Lgs. 196/2003 (Italian Privacy Code) that the data provided with your navigation of the website or the participation in the project “A POSTCARD FOR FLOYD” shall be processed according to the following policy:
- Type of Data Processed
BROWSING DATA
The information systems and software procedures relied upon to operate this web site acquire personal data as part of their standard functioning; the transmission of such data is an inherent feature of Internet communication protocols.
This data category includes the IP addresses and/or the domain names of the computers and terminal equipment used by any user, the URI/URL (Uniform Resource Identifier/Locator) addresses of the requested resources, the time of such requests, the method used for submitting a given request to the server, returned file size, a numerical code relating to server response status (successfully performed, error, etc.), and other parameters related to the user’s operating system and computer environment.
These data are necessary to use web-based services and are also processed in order to
– extract statistical information on service usage (most visited pages, visitors by time/date, geographical areas of origin, etc.);
– check functioning of the services.
Browsing data are kept for no longer than seven days (except where judicial authorities need such data for establishing the commission of criminal offences).

WEB FORMS AND A POSTCARD FOR FLOYD PROJECT
GG, as the Data Controller, informs you that your personal data and personally identifiable information hereinafter referred to as “Personal Data” or just “Data”, which have been or will be collected, including verbally collected, by us or by a third party, may be processed in full compliance with the EU Regulation. The Data collected for the project are name, surname, pseudonym, address, telephone number, e-mail address, ID card, date and place of sending of the postcard, eventual text, drawings and images provided on or with the postcard.
- Legal Basis and Purpose of the Processing
For browsing the website
The scope of the processing is to enable the browsing on the website, according to your willingness to visit the website and use its features
For the web form and A postcard for Floyd project
The legal basis of the processing is your free consent (Art. 7 of GDPR), for the following purposes:
– printing of the postcard on books, magazines, press releases, advertising posters;
– posting of the postcard on websites, social media, press releases, advertising posters;
– exhibition of the postcard on art exhibition, art fairs, media events;
– informational and promotional events correlated to the publications, exhibition and any other events related to the project “A postcard for Floyd”;
– the name of the author, the date and place of the sending will be published along with the postcard and its texts, drawings and images.
- Data collection, Processing Methods, Data Storage Times and other Information
Your Personal Data will be collected both via paper postcards/forms and via forms on the website. Your data will be processed on paper and by electronic and/or automatic means, in such way as to guarantee data security and confidentiality.
Browsing data will be collected during your visit on the website.
The Data Controller shall process your Personal Data for the period of time necessary for the abovementioned purposes until consent is revoked and in no case longer than the period of time permitted by law after the termination of your relationship with the Data Controller.
The right to withdraw consent is not retroactive, which means any processing operations which took place before you revoked your consent will not become illegal on withdrawal.
The postcards won’t be put up for sale and will be stored for archiving.
Your data will not be used for Profiling or automated decision-making.
- Access to the Data and Communication of the Data
Your Data can be accessed for the purposes mentioned at the above points:
– web host, web provider and for website maintenance.
– by publishers, press, social media outlets, advertisers, art galleries both in Italy and abroad.
This parties act as data processors.
The full list of all those who have or can have access to your Data is available at our registered office.
Without your express consent (Article 6, Points b) and c) of the EU Regulation), the Data Controller may communicate your Data to Supervisory Bodies, Judicial Authorities, assurance companies for the provision of assurance services, and other parties to which the law prescribes that the Data must be communicated for the abovementioned purposes.
Such parties shall process your data as data controllers that are independent from the Data Controller.
Your Data shall not be disseminated.
- Transfer of the Data
Your Personal Data are stored in physical archives and digital devices that are located at the registered office of the Data Controller or at providers, within the European Union.
It is understood that, if necessary, the Data Controller shall have the right to transfer your Data to non-EU countries. In this case, the Data Controller hereby guarantees that any transfer of your Data outside the EU shall be carried out in compliance with the applicable laws, after drawing up the conditions of the contract and carrying out the standard inspections provided for by the European Commission.
The Data Controller has applied adequate technical and organizational measures to guarantee a proper level of security both for the Data stored on its own devices, and for the Data stored by providers, in full compliance with Article 32 of the EU Regulation.
- How You Communicate Your Data and what Happens if You Do Not Communicate Your Data
You are not required to communicate your Data.
For browsing data, your choice to disallow data collection will prevent visiting the website or some of its features. For the project A postcard for Floyd, data communications is essential to your participation in the project. You are free not to communicate any Data or you may revoke your consent to its processing at a later time.
- Your Rights
As the owner of your Data, you have the following rights provided for by Article 15 of the EU Regulation:
- You have the right to have the Data Controller tell you whether your Personal Data is being processed and if they are, you have the right to access your Personal Data and the following information:
- a) the purpose of the processing
- b) the type of Personal Data being processed
- c) the parties to which your Personal Data have been or will be communicated, and in particular whether such parties are located abroad or are part of an international organization
- d) if possible, the designated storage time of your Personal Data or, if not possible, the criteria by which the storage time is determined
- e) the right to request from the Data Controller that your Data shall be corrected or deleted or that the processing shall be limited, and the right to revoke your consent to the processing
- f) the right to file a claim with the inspection authorities (e.g. the “Garante”, the Italian Data Protection Authority)
- g) if your Personal Data was not collected from you, you have the right to receive information about the origin of the collected Data
- h) whether automated decision-making takes place, including profiling
- If your Personal Data are transferred abroad or to an international organization, you have the right to know whether any adequate guarantees are applied to the transfer according to Article 46 of the EU Regulation.
- Upon request, the Data Controller shall send you a copy of your Personal Data being processed.
If you would like to receive extra copies, the Data Controller may charge you for reasonable management costs. If you submit your request by electronic means, any information shall be sent to you in a commonly used electronic format, unless you specify otherwise.
- The right to receive a copy of your Personal Data being processed mentioned in the above paragraph 3 may not infringe the rights or the freedom of any third party.
Moreover, if possible, you have the following rights provided for by Articles from 16 to 22 of the EU Regulation:
– the right to amend your Personal Data
– the right to have your Personal Data deleted
– the right to have the processing of your Personal Data limited
